1. Introduction and Acceptance of Terms
Welcome to Realis Sim. These Terms of Service (“Terms”) govern your access to and use of the Realis Sim platform, including all content, features, and services provided by Realis Sim. By accessing or using the platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the platform. Realis Sim is an immersive simulation platform designed to bridge the gap between theoretical knowledge and practical application in project management. It offers a risk-free environment for users to hone their skills by making critical decisions in real-time.

2. About Realis Sim
Realis Sim addresses the challenge where traditional project management training often lacks real-world unpredictability and practical decision-making, leading to limited practical experience, high costs for on-the-job training, and the risk of real project failures. Realis Sim addresses these issues by providing a dynamic, interactive environment for realistic scenario-based learning.

3. Simulation Methodology and Content
Realis Sim utilises a unique simulation methodology, ensuring authentic experiences and unparalleled realism and educational effectiveness. This includes proprietary algorithms for realistic scenarios, adaptive difficulty based on user performance, detailed analytics and performance tracking, comprehensive feedback mechanisms, and an evidence-based learning methodology. The platform offers 15 diverse project simulations.

These scenarios cover multiple industries for comprehensive training, including IT & Software Development, Property & Construction, Marketing & Events, Manufacturing & Engineering, Energy & Utility, and Finance & Insurance. Users navigate complex scenarios with real-time management tools, which include budget management and tracking, team morale and performance metrics, risk identification and mitigation, issue resolution workflows, stakeholder communication challenges, and resource allocation decisions.

4. User Accounts

• Account Creation: To access certain features of Realis Sim, you must register for an account. This will require providing your email address and password, first name, and last name. Providing a phone number is optional.
• Account Security: You are responsible for maintaining the confidentiality of your account credentials (email address and password) and for all activities that occur under your account. You agree to notify Realis Sim immediately of any unauthorised use of your account.
• Accuracy of Information: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

5. Permitted Use
You agree to use Realis Sim only for its intended purpose: an immersive simulation platform for project management training. You must not use the platform for any unlawful purpose or in any way that interrupts, damages, or impairs Realis Sim or access to it.

6. Prohibited Conduct
You agree not to:

• Use the platform in any way that breaches any applicable local, national, or international law or regulation.
• Use the platform in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.
• Transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).
• Knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware, or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
• Attempt to gain unauthorised access to, interfere with, damage, or disrupt any part of the platform, the server on which the platform is stored, or any server, computer, or database connected to the platform.

7. Intellectual Property Rights
All content, features, and functionality on Realis Sim, including software, text, graphics, logos, and trademarks, are owned by Realis Sim or its licensors and are protected by United Kingdom and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You are granted a limited, non-exclusive, non-transferable licence to access and use the platform for your personal and internal business use as described in these Terms.

8. Payment and Billing
If Realis Sim requires payment for its services, details regarding subscription plans, pricing, billing cycles, and accepted payment methods will be clearly communicated. Please note that payment processing services for Realis Sim transactions are handled by Stripe. When you make a payment, your payment details are securely processed by Stripe, and Realis Sim does not directly store your full payment card information.

9. Data Protection and Privacy
Realis Sim collects personal data such as email address, password, first name, last name, and optionally phone number for user accounts. This data is used for analytics, improving the service, and marketing. Data is not shared with third parties, except for payment processing via Stripe. Data will be kept for as long as the users have their accounts open. Users have the right to access their personal information: Email Address, Password, First Name and Last Name, and Phone Number (if provided). Realis Sim implements security measures to protect user data. There is no international data transfer of personal information as users have direct access to their data within the platform. 10. Disclaimer of Warranties
The Realis Sim platform is provided “as is” and “as available” without any warranties of any kind, either express or implied. Realis Sim does not guarantee that the platform will be uninterrupted, error-free, or secure, or that defects will be corrected.

11. Limitation of Liability
To the fullest extent permitted by law, Realis Sim will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the platform; (ii) any conduct or content of any third party on the platform; (iii) any content obtained from the platform; and (iv) unauthorised access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

12. Indemnification
You agree to defend, indemnify, and hold harmless Realis Sim, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable solicitors’ fees) arising out of or relating to your violation of these Terms or your use of the platform.

13. Termination
Realis Sim reserves the right to suspend or terminate your account and access to the platform at its sole discretion, for any reason, including, without limitation, if you breach these Terms. Upon termination, your right to use the platform will immediately cease. Users may close their accounts at any time.

14. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of England and Wales. You agree that the courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter or formation (including non-contractual disputes or claims).

15. Changes to Terms
Realis Sim reserves the right to modify these Terms at any time. We will notify you of any significant changes via email to your registered email address. Your continued use of the platform after such modifications constitutes your acceptance of the new Terms. The “Effective Date” at the top of these Terms will also be updated.
